Outcome achieved
The Government of Nepal passed the Contribution-based Social Protection Bill 2074 (2017) on 24 July 2017. The Bill was drafted by a tripartite committee under the Social Security Fund (SSF), through a consultative process. The Act has provisions for eight types of Social Security Schemes: (a) medical care and health insurance, (b) maternity protection, (c) workplace injury, (d) disability benefits, (e) old age benefits, (f) dependent family benefits, (g) unemployment insurance, and (h) other social securities specified by the Fund.
ILO's contribution to the outcome
The ILO, with RBSA funding [NPL/14/03/RBS], provided support to enhance the knowledge base for constituents and key stakeholders through advisory services, training, sharing of successful experiences from other countries and through analytical work. Some of the outputs provided by the ILO included:
• a high-level advocacy report An analytical briefing on the social security sector in Nepal;
• analysis of social protection provisions in the new Constitution;
• a high-level multi-stakeholder study visit to Thailand; and
• comments on successive drafts by the Bill by social protection experts.
Enhanced knowledge of the stakeholders contributed to informed social dialogues and inputs for the drafting of the Social Security Bill. The ILO also provided experts’ input to the initial draft of the Bill in order to ensure that the act is aligned with the principles of the Social Security (Minimum Standards) Convention, 1952 (No. 102).
Gender equality & non-discrimination
The new Bill includes essential provisions on gender equality and non-discrimination, especially in relation to maternity protection, disability benefits and dependency.
