Outcome achieved

The Lao Social Security Organisation (LSSO) adopted the Instruction (Amended Version) on the Implementation of the Law on Social Security, No. 0060/MLSW on 11 January 2023. The Instruction elaborates the social security provisions by providing details on the calculation of benefits and application of eligibility criteria, among others. It clarifies and instructs more clearly on the implementation of some articles in the 2018 Social Security Law so that decentralised offices have a uniform reference for implementation of the Law nationwide.

ILO's contribution to the outcome

ILO supported LSSO and the Ministry of Health through a preliminary review of the Social Security Law and Health Insurance Law against C102 and through a comprehensive actuarial valuation of the National Social Security Fund, including Health Insurance, with financial support from the Republic of Korea, EU, and Luxembourg. The Actuarial Working Committee was established to review the actuarial valuation of the National Social Security Fund. ILO organised three technical trainings and several working sessions to strengthen their capacities. ILO with financial support from the Republic of Korea also provided technical support on research related to understanding the nature of informality in Lao PDR, analysing the characteristics of informal employment, and formulating strategies to expand social security coverage. The draft report was prepared and the findings and recommendations validated by LSSO and national partners, including the Lao Federation of Trade Unions (LFTU), Lao National Chamber of Commerce and Industry LNCCI) and civil society, in July 2023. All this work feeds into the ongoing discussions to amend the Social Security Law next year. A study visit to Indonesia, peer learning from the Philippines, and several capacity building workshops were organised, to enhance the knowledge and capacities of national partners such as LSSO, Ministry of Labour and Social Welfare, LFTU, LNCCI, line ministries, and civil society on making social protection policies. Lao officials participated in trainings in the Republic of Korea, Viet Nam, and at ITC, Turin.

Gender equality & non-discrimination

The MOLSW adopted the Management of Domestic Workers, No. 4369 / MoLSW, on 02/11/2022. This decision sets out the regulations on management, monitoring and inspection of employers of domestic workers. This is to ensure safe and fair work to protect the rights and interests of workers under the law and regulations. It sets out that employers have to facilitate their domestic workers to register with social security. If the domestic workers are not members of LSSO, employers are responsible for the cost of sickness, injury or death of the worker.
